Regarding to the right click issue with gedit seems to be a gedit bug, Adwaita, Zukitwo, and others seem to have this issue as well, i would state that as a gedit bug.
When i tried this theme in XFCE i found out that GTK2 menuitems are smaller than the GTK3 ones, i personally would like to increase xthickness & ythickness with 1px to keep semi-consistency with the GTK3 counterparts.
I don't know what you would like of this, so i left that one out for the moment, meaning no change.
Also i would really recommend trying out the Cinnamon desktop with Nemo filebrowser, and xfce4-terminal, but it's all up to you, but i fell direcly in love with it since day one.

Anyhow i cannot simply copy & paste the window captions from the new Adwaita theme, since it will not work togheter with metacity 1.x code since it's not compatible.
And i cannot take my code in the new Adwaita theme since it's not compatible with metacity 2.x 3.x code.
So my only option is this take the new Adwaita theme, learn the new code, and start over theming it to look like the old one, with just newer captions.
And that's why it's so hard, but i will try and see were it goes. - May 29 2013

Yes it will not blend in perfecly, but those captions is the ones i want, though porting the metacity theme will be alot of work, for me atleast, since it does not use pixmaps.
If anyone would help me out i would love it, perhaps ask the designer, but this is just to much work for me.

Oh btw i have made an addon that adds a border to the top panel, just like in Gnome 3.0

The most challenging part will be the buttons,

Before i had to manually add a border to the nautilus sidebar, this is now not needed in nautilus 3.6

The easiest way seems to be to start over again and using the latest Adwaita theme for base.

1. If I open a new terminal as a tab the scrollbar changes?
Ahh yeah, i can confirm that, i even also saw that Tabs looks aswell
*This should be fairly easy*, since i am going to make the tabs in Gnome-terminal transparent as well.
2. The theme are crash prone here when restarting the shell with alt+f2 "r" especially with a few application open e.g. firefox will do it for sure at least here. It will crash me to the opps logout screen. This use to happen a lot with the default GTK3 but I can't really get the default theme to crash anymore. Perhaps something changed in the original codebase?
This is absolutley something i am really going to look into.

under the Window section in Gnome-Tweak-Tool.
If you do not have Gnome-Tweak-Tool,
i recommend to install it ;)
